Terms and Conditions

These terms and conditions together with the registration form (if applicable) (Terms) govern the Australasian Institute of Mining and Metallurgy (ABN 59 836 002 494) (AusIMM) and each delegate (Delegate, You or Your) that has either: (1) purchased a ticket to attend the relevant event or conference (Event); or (2) has been invited by AusIMM to attend the Event.

You acknowledge and agree that these Terms apply to all Events whether delivered online, in-person, a combination of in-person and online or any other format.

You acknowledge that You have read and agree to be bound by these Terms upon: (1) submitting Your registration to AusIMM (whether hardcopy or electronic) for the Event; or (2) attending the Event if You are not required to submit a registration to AusIMM.

1. Registration

1.1 Your registration is subject to acceptance by AusIMM, confirmed in writing (including, but not limited, to email) (in Writing) after AusIMM has received Your fully completed registration and the fee (if required) related to Your registration (Fee). AusIMM accepts VISA, MasterCard and AMEX credit cards. AusIMM may not be able to accept Your registration if You have provided incomplete details in Your registration form or failed to pay the Fee, or otherwise as necessary to protect AusIMM’s legitimate business interests.

1.2 AusIMM will endeavour to confirm Your registration in Writing within two (2) business days of receipt of Your fully completed registration and Fee.

1.3 If You do not choose to register online, Your credit card payment must accompany Your registration form in order for it to be processed and confirmed. AusIMM is not able to process registrations until payment has been received.

1.4 If AusIMM has invited You in Writing to attend the Event without the need to register for the Event and/or make any payment, You must provide Your confirmation of attendance to AusIMM within the time specified in the invitation (if any).

1.5 AusIMM reserves the right to change the Fee at any time, which shall not affect registrations confirmed in Writing by AusIMM before the announcement of such a change.

1.6 Once You have received Your confirmation in Writing from AusIMM, please check Your confirmation and inform AusIMM immediately in writing of any alterations required to Your registration.

1.7 To ensure that Your Event materials and catering requirements are able to be provided at the Event, please register by 5:00pm two (2) business days prior to the Event. Registrations can still be lodged after this time, including in person at the Event, however, please note that in some cases Event materials and/or catering cannot be guaranteed for last minute registrations. In these instances, we will endeavour to forward Event materials to Delegates after the Event.

1.8 If You are registering for an Event on behalf of another person, it is Your responsibility to ensure that the Delegate is aware of these Terms. By completing the registration for the Event, You are warranting that You have made the Delegate aware of these Terms and that they have accepted them.

1.9 Please contact AusIMM on the contact details set out in clause 9 below if You do not receive Your confirmation advice or if You have any enquiries regarding payments.

2. Cancellation and Transfers by Delegates

2.1 Notification of cancellation of Your registration for an Event must be made in Writing (Notification) and sent to AusIMM at conference@ausimm.com. The Notification must include Your membership details (if applicable) and any other reasonable requirements of AusIMM for cancellation as may be notified to You from time to time.

2.2 If the Notification is received by AusIMM twenty-eight (28) days or more before the date of the Event (Final Cancellation Date), AusIMM will provide You with a refund of the Fee minus any reasonable administration costs (provided such administration costs are validly incurred by AusIMM in connection with the Event). To protect AusIMM’s legitimate business interests (such as costs incurred to produce the Event) refunds may not be made for cancellations received after the Final Cancellation Date, subject to AusIMM’s sole discretion. Refunds will not be made for cancellations made due to a change of mind or change in personal circumstances.

2.3 You may cancel an activity or transfer to another activity at the Event (including, but not limited to, sessions, luncheons, workshops, presentations, seminars, tours or any other activity at the Event) (Component) by notifying AusIMM in Writing at least fourteen (14) days prior to the Component. Refunds may not be granted to You if You fail to attend or cancel Components or transfer between Components within fourteen (14) days of the Component, subject to AusIMM’s reasonable discretion. Transfers are subject to the applicable registration Fee for the Component to which You have transferred.

2.4 If You wish to request approval to send a substitute to the Event or to a Component in Your place, You must make such a request to AusIMM at conference@ausimm.com in Writing fourteen (14) days prior to the Event or Component.

2.5 A substitution in accordance with clause 2.4 may be subject to additional fees, including, but not limited to, changes to the Fee (e.g., if the substitute is a non-member), and a request for substitution may be declined by AusIMM, acting reasonably.

2.6 If You wish to bring a spouse, friend of colleague to the Event networking functions, You will need to purchase additional tickets for Your guest(s). Please note that guests may participate in networking activities only and will have no access to the Event.

3. Modification, Postponement, Cancellation by AusIMM

3.1 AusIMM reserves the right at any time to: (a) change the format, participants, content, location and timing or any other aspect of the Event; (b) postpone the Event or any part of the Event; or (c) cancel the Event or any part of the Event, provided that such change, postponement or cancellation will only be actioned by AusIMM if it is reasonably required in accordance with AusIMM’s legitimate business interests, by providing Written notice to You in advance of such change, postponement or cancellation (to the extent reasonably practicable). AusIMM will not be liable to You for any damages, costs, losses or expenses of any kind incurred or suffered by You as a result of or in relation to AusIMM modifying, postponing or cancelling the Event or any part of the Event. If an Event is changed, cancelled or postponed by AusIMM, and You are no longer able to attend such Event, AusIMM will refund the Fee to You, minus any reasonable administration costs (provided such administration fees are validly incurred by AusIMM in connection with the Event).

3.2 AusIMM will not be in breach of these Terms for any failure to provide any Event that is caused by or arises from any event or circumstances beyond AusIMM’s reasonable control, including any acts of God, severe storm, flood, fire, earthquake or other natural occurrences, war, terrorism, civil commotion and riots, strikes and industrial action, epidemic, pandemic or public health emergency, or any resulting governmental action including work stoppages, mandatory business, service or workplace closures, full or partial lockdowns of affected areas, quarantines, border closures and travel restrictions or acts or omissions of governments and regulatory authorities (Force Majeure Event), and the time for performance of any impacted Event will be extended accordingly. If AusIMM’s performance of the Event is delayed or prevented by a Force Majeure Event, AusIMM will notify You of the nature, extent, affect and likely duration of the circumstances constituting the Force Majeure Event as soon as reasonably practicable and, as soon as reasonably practicable after cessation of the Force Majeure Event, will reschedule and provide the relevant Event. AusIMM will refund any Fees paid in connection with a Event the subject of a Force Majeure Event upon written request by You, minus any reasonable administration costs (provided such administration fees are validly incurred by AusIMM in connection with the Event).

4. Delegate’s rights and obligations at the Event

4.1 AusIMM reserves the right, without any liability, to refuse admission to, or to eject You from the Event, in its absolute discretion, including, but not limited to, Your failure to comply with these Terms or if in the opinion of AusIMM You represent a security risk, nuisance or annoyance to the running of the Event. If You are ejected from the Event, a refund of the Fee may be facilitated in some circumstances (at AusIMM’s reasonable discretion).

4.2 You agree to comply with all reasonable instructions issued by AusIMM, AusIMM’s Representatives, the venue operators or platform facilitators at the Event.

4.3 All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited at the Event and/or in or at the venue. You may seek permission from presenters, sponsors and/or attendees at the Event prior to taking photographs, screenshots or recordings of presentations, exhibition stands, display products, speakers and/or attendees at the Event.

4.4 You acknowledge that You may be filmed, sound recorded and/or photographed by AusIMM, media or any other party at the Event and AusIMM may use or approve the use of a film, sound recording and/or photograph which depicts or includes You for any purpose and in any way whatsoever.

5. Disclaimer of Warranty, Limitation of Liability and Indemnity

5.1 Disclaimer of Warranty

To the fullest extent permitted by law, but subject to clause 5.2 and 5.3, AusIMM excludes all implied representations, warranties, terms and conditions of any kind whatsoever (whether implied by common law, statute or otherwise) and the application or availability of any statutory rights (including any implied representations, warranties, terms or conditions or any statutory guarantees that the Event is of satisfactory quality or fit for purpose).

5.2 Limitation of Liability

5.2.1 Subject to clause 5.3, neither party will be liable to the other party under or in respect of these Terms for any consequential, indirect, or special damages, regardless of whether that liability arises in contract, tort (including negligence), at common law, in equity, under statute, under an indemnity or otherwise howsoever arising.

5.2.2 You assume responsibility for the use of, and outcomes obtained from Your participation in, the Event.

5.2.3 To the fullest extent permitted by law and subject to clause 5.3, AusIMM’s total liability of any kind to You arising out of or related to these Terms (including but not limited to warranty claims), regardless of the forum and regardless of whether any action or claim is based on contract, tort (including negligence), breach of statue or otherwise, exceed the total Fee paid by You in respect of the Event.

5.3 Statutory Rights and Consumer Guarantees

5.3.1 Nothing in these Terms is intended to exclude, restrict or modify any rights that You may have under the Competition and Consumer Act 2010 (Cth) (CCA) or any other legislation which may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into this Agreement or provides statutory guarantees in connection with these Terms, in respect of goods and services supplied, AusIMM’s liability for breach of such condition, warranty, other term or guarantee is limited (at AusIMM’s election):

(a) in the case of supply of goods, AusIMM doing any one or more of the following: (i) replacing the goods or supplying equivalent goods; (ii) paying the cost of replacing the goods or of acquiring equivalent goods; and/or (iii) paying the cost of having the goods repaired; or

(b) in the case of supply of services, AusIMM doing either or both of the following: (i) supplying the services again; and/or (ii) paying the cost of having the services supplied again.

5.4 Indemnity

You agree to fully indemnify and hold AusIMM, its employees, agents, contractors and sub-contractors (Representatives) harmless from any claim, cost, demand, liability or damage (including legal costs, professional costs and other expenses on a full indemnity basis) incurred by AusIMM and/or its Representatives arising out of or in connection with the Event, including, but not limited to: (1) Your breach of these Terms; (2) Your use of the Event venue or attendance at the Event; (3) any damage by Your act or omission to the Event venue or any goods located at the Event venue; or (4) Your infringement of any intellectual property or other right of any third party.

6. Privacy

Your registration for the Event and attendance at the Event, and any handling of Your personal information, is at all times subject to the relevant privacy collection statement and AusIMM's Privacy Policy, as amended from time to time and accessible via the webpage: ausimm.com/about/governance/privacy-policy.

By registering for the Event, You acknowledge and agree that Your personal information may be displayed at the Event (for example online as part of a delegate list if You have opted-in to do so). At the time of registration, You will have the option to provide Your photo and biography for use and display at the Event.

At an Event, exhibitors may have access to software that enables exhibitors to electronically scan Your name badge with Your consent. Once Your name badge has been electronically scanned, the exhibitor will obtain access to Your personal information, including Your name, title, company, address and email, provided by You during the registration process. AusIMM is not responsible for the subsequent use, disclosure or handling of Your personal information by any exhibitor or any other person who obtains Your personal information using such electronic scanning software or if You otherwise provide Your personal information to a third party during an Event (for example if You provide Your email directly to third party during an online chat).

7. Discount Eligibility Details

7.1 Only one discount is applicable at a time and discount offers cannot be combined. Where You are eligible for more than one discount, the greatest discount will be applied to Your registration.

7.2 All registrations with discount selections are subjected to an audit at a later date. Fraudulent selection of a discount or selecting a discount where eligibility cannot be proven will result in payment of the difference.

7.3 Please note that not all discounts apply for all Events. Please check the specific Event details to check which discounts apply.

7.4 The following eligibility rules apply to the specified discount type:

7.4.1 AusIMM Member Rate: You are a financial (paid) member of AusIMM. AusIMM membership fees are due by 1 January each year.

7.4.2 Student Registration: You are a student completing Your degree full-time at a tertiary institution. Proof of Your current enrolment and status as a full-time student must be submitted with Your registration form. All Delegates registering at the student rate will be listed as “student” along with Your institution on Your name badge and in the attendee list.

7.4.3 Abstracts and Papers selected by AusIMM: You have submitted abstracts and papers which have been selected by AusIMM and which may be used at the Event.

8. General

8.1 These Terms are governed by and are to be construed in accordance with the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria.

8.2 AusIMM may amend these Terms from time to time by posting a revised version on AusIMM’s website or by otherwise notifying You in Writing. You will be subject to the Terms in force at the time AusIMM registers You in the Event, and any amendments to these Terms will not apply retrospectively.

8.3 If there is a contradiction or inconsistency between these Terms and any other notices, policies, communications or documents relating to an Event then these Terms will prevail to the extent of that contradiction or inconsistency.

8.4 If a court determines that any provision of these Terms is invalid or not enforceable, that provision shall be read down or severed to the extent of the invalidity or unenforceability only, without affecting the remaining provisions of these Terms.

Privacy Collection Statement

Privacy is important to the Australasian Institute of Mining and Metallurgy (ABN 59 836 002 494) (AusIMM, we, us or our).

How we use your personal information and who we share it with

AusIMM has collected your personal information on this form, including your member details and credentials, title, name, organisation, position, email address, telephone number and address, image and biography (as applicable), and will use and disclose your personal information for the purpose of processing your registration for, and facilitating your attendance at, the Life of Mine Conference you are registering for or otherwise attending (Co-Hosted Event). AusIMM may have collected your personal information from the co-host for the Co-Hosted Event, The University of Queensland Australia (Co-Host).

If you are filling in this form on behalf of another individual, you confirm that the relevant individual has consented to you providing their personal information to us.

We may use your personal information to provide you with information about the Co-Hosted Event and our products and services, including the products and services of our Co-Hosts, partners and sponsors (with your consent, if applicable), and to otherwise communicate with or manage our relationship with you in connection with the Co-Hosted Event.

In order to deliver the Co-Hosted Event to you, we may also use your personal information for the following purposes: (a) displaying your personal information at the Co-Hosted Event, in a delegate list published at the Co-Hosted Event or displayed online in connection with the Co-Hosted Event (including via mobile applications we may make available); and (b) sharing your personal information to our third-party providers, including online platform providers such as Brella Oy and The University of Queensland Australia, event providers, hotels, venues and/or catering companies and workshop providers and presenters who assist us to facilitate the Co-Hosted Event.

We generally do not share your personal information with the Co-Host, our third party partners, sponsors and exhibitors, but we use your personal information to create de-identified and aggregated data and may share de-identified, aggregated data with the Co-Host, our third-party partners, sponsors and exhibitors regarding the Co-Hosted Event.

Third-parties such as the Co-Host, partners, sponsors, exhibitors and workshop facilitators who take part in an Co-Hosted Event may also collect personal information directly from you in person or online (for example if you provide your name badge to be scanned or you provide your personal information directly to sponsor online). If you provide your personal information to such third-parties, the relevant third parties’ privacy policies will apply to such collection, use and disclosure of your personal information. 

Providing us with the requested information is not required by law. If you choose not to provide us with the requested information or provide incomplete information, we may not be able to process your registration for the Co-Hosted Event.

We will also use, disclose and process personal information (including sensitive information) as set out in our Privacy Policy. It is likely that personal information will be disclosed to overseas recipients (as provided in our Privacy Policy, including the location of those entities). Our Privacy Policy sets out how AusIMM handles personal information including how you can seek to access and correct your information or raise a privacy concern with us and how it will be dealt with. If the (EU) 2016/679 General Data Protection Regulation (GDPR) applies, our legal basis for processing and additional rights which may apply to you are set out in our Privacy Policy.

Opting out of receiving marketing materials

You have the right to opt-out of receiving direct marketing from us at any time. If at any time you wish to stop receiving direct marketing messages about the Co-Hosted Event, the easiest way to do this is to use the unsubscribe feature in the marketing message you have received about the Co-Hosted Event.

You can also contact us at conference@ausimm.com to opt-out of receiving direct marketing about the Co-Hosted Event or otherwise and we can assist you to manage your marketing preferences about the marketing materials you wish to receive from AusIMM.

Our Privacy Policy

Our Privacy Policy contains the contact details of our Privacy Officer and information regarding your rights (including how to withdraw your consent, if applicable) and how you can seek to access and correct your information or raise a privacy concern with us and how it will be dealt with.
